ROAD POLICY

ACCEPTANCE OF PRIVATE ROADS

FOR COUNTY MAINTENANCE                                      

 

3.1        Private roads in a Subdivision may be accepted into the county road system as      public roads by the Commissioners Court for maintenance when the following             requirements are met:

 

A.   The Subdivision must have been constructed prior to January 1, 1980.

 

B.   Each road in the subdivision must contain a sixty (60) foot right-of-way dedicated to Denton County for the use of the public and be clear of all obstructions.

 

C.   The Engineering Division will investigate the drainage within the subdivision to determine if additional improvements are necessary. The cost of constructing the improvements and acquiring the easements will be borne by those making the request for the acceptance. The improvements and the easements must be completed and maintained for one year before the road is accepted by the County.

 

D.   At least six (6) inches of suitable base material (gravel) must be present on all roads.

 

E.   All utilities must be properly installed and the expense for the relocation of same will be borne by the person requesting the acceptance of the roads.

 

F.   Dead-end roads shall have sufficient dedicated right-of-way for construction and maintenance of a cul-de-sac in accordance with the Denton County Subdivision Rules and Regulations.          

 

3.2        Roads accepted for maintenance under this section will be given the lowest paving priority by the County.

 

3.3         The Ex Officio Road Commissioner shall, in his sole and absolute discretion, determine if the roads which are requested to be accepted under this section comply with the requirements of Section 3.1, above.  The Commissioners Court may accept such roads for maintenance upon the recommendation of the Ex Officio Road Commissioner.
