Be it remembered, Commissioners Court of Denton County, Texas was called to order on the 3rd day of January, 2006, at 9:00 a.m. in Commissioners Courtroom, 2nd Floor, Courthouse on the Square, Denton, Texas by Denton County Commissioner Bobbie Mitchell as presiding officer. Commissioners Cynthia White, Sandy Jacobs, and Jim Carter were present, along with County Clerk Cynthia Mitchell’s representative, Deputy Clerk, Erin McCorkle.

Court opened with an Invocation by Jim Heath, followed by the Pledges of Allegiance to the American and Texas Flags led by Amy Phillips, Human Resources Director.

Mr. Heath: Good morning, Commissioners, will you bow your heads, please. Our Heavenly Father, we ask you as we begin this new year, look on our form of govern with much favor. May we have a good year in Your eyes. May this Commissioners Court do things today as you would like them to do. And, Father, we ask You very kindly, look on all of our service people as they stand in harm's way. In Thy name we pray. Amen.

7. B) Approval of Budget Amendment Request #100300 for Operating Equipment for County Jail in the amount of $12,346, and any appropriate action. (Briefing 12-20-05)

14. B) Approval of the Contract for Purchase between Denton County and Pecan Park Estates Homeowners Association, for the purchase of property Parcel 28E for the FM 1171 Project, 2) authorization to proceed with the closing and approval for the County Judge to sign all necessary closing documents to purchase Pecan Park Estates Homeowners Association, for the purchase of property Parcel 28E for the FM 117 Project and 3) direction to the County Auditor to issue a warrant in the amount of the purchase price plus fees for the purchase of this Property with funding to come from the FM 1171, Auditor #63-7360-90-10, and any appropriate action. 14. C) Approval of 1) the Real Estate Contract between Denton County and Chuck Cloud for the purchase of property for the Lake Lewisville Corridor Project, 2) authorization to proceed with the closing and approval for the County Judge to sign all necessary closing documents to purchase the property from Chuck Cloud and 3) direction to the County Auditor to issue a warrant in the amount of the purchase price plus any fees for the purchase of the Chuck Cloud Property, with funding to come from the Lake Lewisville Toll Bridge Corridor, Auditor #7401, and any appropriate action. F) Approval of any appropriate action related to the Attorney General Opinion #GA-0387 (2005) holding that Government Code section 51.961 (g), which requires one-half of the family protection fee collected in divorce suits to be deposited in the child abuse and neglect prevention trust account to be unconstitutional and violating the open court provisions of the Texas Constitution article 1, section 13, concerning the family protection fee.
