How often does the Sheriff's Department hold Tax Sales?
A:
Tax Sales are only held when Orders of Sale are issued from the District Courts in reference to tax judgments for delinquent taxes.  Sales are not always scheduled each month. Real property is required by Texas law to be sold on the first Tuesday of the month. All counties have sales on the same day.

When and where will the tax sales be advertised?
A:
We advertise the sales in the Denton Record Chronicle on the three Wednesdays prior to the first Tuesday of the month if there is a sale set.

Do you have to register for the sales?
A:
There is no formal registration process. You or your representative must be present in person for the sale.

What are the payment requirements?
A:
Is there a deposit required before the sale? Denton County requires payment in the form of a cashier's check or money order for the total amount that was bid. Payment plans are not accepted. Payment is not required at the time of purchase, but the total amount must be paid by 4:00PM on the day of sale unless special arrangements are made with the Sheriff's Department at the time of sale. (Special arrangements are sometimes made if the buyer banks out of state) No deposit is required before the sale.

What is the type of bidding process?
A:
It is an open/oral bid process.

What type of document is issued after the sale?
A:
A Sheriff's Deed is issued to the purchaser.
Q:
Are there any other expenses in addition to the opening bid amount?
A:
All the expenses are included in the opening bid; however there may be additional taxes due on the property that have accrued since the judgment was rendered.

What happens to any property that is not sold to the public at the auction?
A:
What happens to any property that is not sold to the public at the auction? All the property is sold - either to the public or to the taxing entity who received the judgment. If a property goes to the taxing entity - contact can be made with the attorney who represents that entity for purchase information.

Where are the sales posted?
A:
Where are the sales posted? The sale notices are posted at the Denton County Courts Building at 1450 East McKinney Street in Denton, at the Courthouse Annex in Lewisville at 190 North Valley Parkway and at the Denton County Sheriff's Office (visible 24 hours a day).

Does the Sheriff's Department conduct the foreclosure Sales?
A:
No, these are conducted by the trustees or attorneys for the lending institutions involved with the loans. These types of sales are also held on the first Tuesday of the month and are posted at the Denton County Courts Building.
